1. Acceptance and eligibility

These Terms of Use govern access to and use of the Horizons Creator platform, operated by 66.666.608 PAULO VITOR PREVIATTO, registration 66.666.608/0001-68. By creating an account, using the website, purchasing credits, subscribing to a plan or using the API, you agree to these Terms and the Privacy Policy.

You represent that you have legal capacity to contract. If you use the platform on behalf of a company, agency or client, you represent that you are authorized to bind them to these Terms.

2. Service description

Horizons Creator provides AI-powered image generation, variation, editing and enhancement tools, as well as history, projects, brand kits, credits, subscriptions and API access. Features may be added, changed, suspended or removed for security, maintenance, improvement or technical reasons.

Artificial intelligence results may vary, contain inaccuracies or not exactly match the prompt. Users are responsible for reviewing images before publishing, selling, distributing or using them commercially.

3. Account, credentials and security

• You must provide accurate information, keep your email updated and protect your password and API keys.
• The account is personal, except for plans that authorize teams. You must not sell, rent or share credentials.
• You must immediately notify us of unauthorized access, key leakage or suspected fraud.

We may require email verification, reCAPTCHA, request limits or other security measures to protect the platform and its users.

4. User content, images and rights

You retain any rights you have in prompts, uploaded images and other submitted content. By submitting content, you grant us a limited authorization to store, process, transmit and use that content solely to provide the service, prevent abuse, provide support and comply with legal obligations.

You represent that you have the rights, licenses and authorizations required to use uploaded images, trademarks, faces, characters, products and other materials. For tools such as Face Swap, you must have authorization from the depicted person and may not use the service to deceive, harass, defame or harm others.

Paid plans may include commercial use of outputs, but this does not guarantee exclusivity, registrability, absence of similarity to third parties or freedom from intellectual property rights. You must evaluate the intended use and obtain advice when necessary.

5. Prohibited uses

You may not use the platform to:

• Violate laws, copyrights, trademarks, privacy, image rights, reputation or other third-party rights.
• Generate or distribute illegal, fraudulent, abusive, exploitative, discriminatory or harmful content.
• Create deceptive falsifications, impersonation, fraud, fake documents or content that misleads others.
• Bypass limits, abuse trials, create accounts in bulk, reverse engineer, attack infrastructure or share API keys.
• Use the platform for child sexual exploitation content or any material prohibited by law.

We may remove content, suspend features, limit requests or terminate accounts when there is risk, abuse, violation of these Terms or legal obligation.

6. Plans, credits, subscriptions and payments

• Prices, credits, limits and benefits are shown on the pricing page and checkout in effect at the time of purchase.
• Dashboard credits and API credits are separate balances unless expressly stated otherwise.
• Subscriptions may automatically renew until canceled. Cancellation stops future charges but does not automatically refund periods already started, except where required by law or a specific policy.
• Monthly, extra and promotional credits may have validity, rollover rules and specific limitations shown in the plan or checkout.
• Payments will be processed by providers such as Stripe and Asaas, also subject to those providers’ terms.

In case of chargeback, fraud, non-payment or canceled payment, we may suspend the plan, reverse credits and restrict access until resolved.

7. Availability, maintenance and failures

We aim to keep the platform available but do not guarantee uninterrupted or error-free operation. The service depends on internet access, hosting, AI providers, APIs, payment gateways and other third parties that may become unavailable.

When a generation technically fails and the system identifies the failure, credits may be automatically refunded. No refund is due when an output was generated but did not match the user’s subjective preference.

8. Disclaimers and limitation of liability

The platform is provided as available. To the maximum extent permitted by law, we do not guarantee that outputs are exclusive, fit for a specific purpose, error-free, safe for publication or free from third-party rights.

You are responsible for the use, publication, distribution and consequences of generated content. To the maximum extent permitted by law, we will not be liable for indirect losses, lost profits, data loss, reputational damage or damages resulting from improper use of the platform.

9. Suspension, termination and deletion

You may cancel your subscription and request account deletion through available channels. We may suspend or terminate accounts for violation of these Terms, fraud, security risk, legal requirement, non-payment or abuse.

After termination, certain data may be retained for the period necessary for legal obligations, financial records, fraud prevention, dispute resolution and exercise of rights.

10. Changes, governing law and contact

We may update these Terms to reflect legal, commercial or technical changes. Material changes will be communicated by reasonable means and the current version will remain published on this page.

These Terms are governed by Brazilian law. The courts of Três Lagoas/MS are elected, subject to mandatory consumer rights where applicable.
